Areas of Family Law We Cover

Minute of agreement

A minute of agreement is a formal legal contract that records an agreement between two or more parties. It is usually registered in the Books of Council and Session. This makes it a public document. They are most commonly used in separation but can be entered at the early stages of a relationship in the form of a cohabitation agreement or a pre-nuptial agreement.

Divorce

Under Scots Law there is only one legal ground for divorce. This is is the irretrievable breakdown of the marriage. This must be proved by one of the following: 1. Adultery 2. Unreasonable behaviour. 3. Separation evidence by one year of separation where you have the consent of your spouse 4. Two years separation (no consent is required) Divorces can only be granted by the court. Matters surrounding the finances can often be agreed by way of a minute of agreement but where they cannot the court can make orders. Before a divorce is granted any issues or disputes in relation to finances or the care or residence of the children must be resolved.

It is vital that you obtain the proper legal advice to ensure that you obtain a fair settlement should your marriage break down.

Section 28 Orders

Section 28 of the Family Law (Scotland) Act 2006 allows a former co-habitant to apply to the court for financial compensation after the relationship ends. They can apply to the court for a capital sum. There is a strict one year time limit on making a claim. There is no ability to extend this and accordingly obtaining advice at an early stage is key to protecting your interests.
